These terms govern your use of the Birdy Android application ("the App") provided by Albin Viktor Lindblom ("we", "us").
1. Age requirement
You must be at least 13 years old to use Birdy.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your personal, non-commercial use. You may not:
- Redistribute the App or its bundled assets (species data, model files, font files) outside of the Google Play Store distribution.
- Reverse-engineer the App except where permitted by mandatory law.
- Use the App to scrape, harvest, or aggregate data from third-party services.
3. AI classification is approximate
Birdy uses machine-learning classifiers to suggest bird species from images and audio. Classifications are approximate and may be wrong. Birdy is an educational and field-journaling tool, not a substitute for a trained ornithologist, a published field guide, or expert identification when accurate identification matters (e.g., legal hunting, sensitive surveys, conservation work).
4. Content sources
Encyclopedia text and reference photos are derived from Wikidata, Wikipedia, and Wikimedia Commons under Creative Commons Attribution-ShareAlike (CC BY-SA) licenses. Attribution is preserved in the app's About screen.
Machine-learning models bundled with the app:
- AIY Birds V1 (image classifier) — Google, Apache 2.0.
- BirdNET-Lite v2 (audio classifier) — Cornell Lab of Ornithology. Source code under MIT; model weights under CC BY-NC-SA 4.0 (NonCommercial). Audio identification is provided as a free feature for all users in compliance with the model's license.
5. Premium purchases
Premium features (PDF export, season statistics, premium field badges) are sold via Google Play Billing as either:
- An annual subscription, which auto-renews unless cancelled at least 24 hours before the end of the current period, per Google Play's standard terms.
- A lifetime one-time purchase, which is non-recurring.
Refunds follow Google Play's refund policy. Audio-identification is not behind a paywall and remains free for all users.
6. No warranty
The App is provided "as is" without warranties of any kind, either express or implied, including but not limited to fitness for a particular purpose, accuracy, or non-infringement. To the extent permitted by law, we disclaim all warranties.
7. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or exemplary damages arising from your use of the App. Nothing in these terms limits liability that cannot be limited under mandatory consumer law.
8. Termination
We may terminate or suspend access to the App at any time, with or without notice, if you violate these terms. You may stop using the App at any time by uninstalling it.
9. Governing law
These terms are governed by Swedish law. Disputes are subject to the exclusive jurisdiction of the courts of Stockholm, Sweden, except where mandatory consumer law gives you the right to bring claims in your local court.
10. Changes
We may update these terms from time to time. Material changes will be noted in release notes. The "Last updated" date above reflects the current version.
